These Terms and Conditions govern the use of the Jaguar Tours website, as well as the request, quotation, booking, and provision of tourism services offered, coordinated, or arranged by Jaguar Tours.

By using this website, requesting information, asking for a quote, making a reservation, or purchasing any of our services, the user acknowledges that they have read, understood, and accepted these Terms and Conditions.

1. Supplier Information

Jaguar Tours is a company dedicated to the design, coordination, operation, and/or arrangement of tourism services in Mexico, including vacation trips, cultural tours, religious experiences, themed trips, customized programs, and related services.

For the purposes of these Terms and Conditions, Jaguar Tours may act as a direct operator, a coordinator of tourism services, or an intermediary between the customer and various service providers, such as hotels, transportation companies, tour guides, restaurants, venues, airlines, insurance companies, local operators, or other tourism providers.

3. Requests, Quotes, and Availability

Requests made through the website, forms, email, WhatsApp, phone, or any other contact channel do not constitute an automatic reservation.

All quotes issued by Jaguar Tours are subject to availability, dates, number of passengers, type of services requested, supplier terms and conditions, current rates, applicable exchange rates, and confirmation of payment within the specified timeframe.

The rates, itineraries, hotels, transportation, tickets, experiences, and other services included in a proposal are subject to change until the reservation has been formally confirmed by Jaguar Tours.

The quote may specify a validity period. If the customer does not confirm within that period, Jaguar Tours may update prices, terms, or availability.

4. Reservation Confirmation

A reservation will be considered confirmed only when the conditions specified by Jaguar Tours in the corresponding quote have been met, which may include:

the submission of complete customer or group information,
written acceptance of the proposal,
payment of the advance, deposit, or applicable balance,
confirmation of availability by suppliers,
and the issuance of a formal confirmation by Jaguar Tours.

The payment of an advance or deposit does not, by itself, guarantee all services if essential customer information, travel documentation, supplier confirmation, or compliance with specific program requirements are missing.

5. Prices and Payment Methods

Prices may be expressed in Mexican pesos, U.S. dollars, or another currency, depending on the type of service, market, supplier, or specific quote.

When prices are listed in a foreign currency, the final amount in local currency may vary depending on the exchange rate in effect at the time of payment, bank terms, payment platform fees, or charges from financial intermediaries.

Jaguar Tours may accept payments via bank transfer, credit card, debit card, authorized payment platforms, or other previously agreed-upon methods.

Bank fees, international payment fees, exchange rate differences, applicable taxes, or costs associated with the payment method may be the customer’s responsibility, unless otherwise indicated in the quote.

6. Services Included and Not Included

Each program, package, tour, or experience must specify which services are included and which are not.

In general, a proposal may include, as appropriate:

lodging,
ground transportation,
transfers,
guides,
admission tickets,
meals,
cultural experiences,
religious visits,
themed activities,
logistical coordination,
assistance during the trip,
or other previously agreed-upon services.

Unless expressly stated in the quote, the following are not considered included:

domestic or international flights,
travel insurance,
personal expenses,
tips,
visas, immigration permits, or documentation,
meals not specified,
beverages,
additional services requested at the destination,
baggage fees,
local taxes not included,
voluntary changes made by the customer,
medical services,
or any other item not listed as included.

7. Changes to itineraries and services

Jaguar Tours will make every effort to adhere to the confirmed itineraries, schedules, routes, hotels, and services. However, certain elements may be subject to change due to operational, weather, logistical, or safety reasons; availability; force majeure; instructions from authorities; changes in suppliers; or circumstances beyond Jaguar Tours’ control.

When adjustments are necessary, Jaguar Tours will endeavor to offer reasonably equivalent alternatives, subject to availability and prevailing conditions.

Changes requested by the customer after confirmation may result in additional costs, rate differences, supplier penalties, or administrative fees.

8. Cancellations by the customer

Cancellation policies will depend on the type of service booked, travel dates, supplier terms, season, group size, how far in advance the cancellation is made, and the specific terms of each quote.

The customer acknowledges that some services may be non-refundable, subject to penalties, or require advance payment to guarantee availability, especially during peak seasons, for groups, religious tours, private experiences, transportation, hotels, tickets, or personalized services.

All cancellation requests must be submitted in writing through Jaguar Tours’ official channels.

The refundable amount, if applicable, will be determined based on the terms accepted in the quote, payments made, supplier penalties, expenses already incurred, and the corresponding administrative fees.

9. Cancellations or Changes by Jaguar Tours

Jaguar Tours may cancel, modify, or reschedule a service when there are justifiable reasons, such as lack of availability, failure to make payments, force majeure, security conditions, health emergencies, site closures, blockades, natural disasters, social unrest, instructions from authorities, or cancellations by third-party providers.

In such cases, Jaguar Tours will endeavor to notify the customer as soon as possible and, when feasible, offer alternatives such as a date change, substitution of services, a credit, or a partial or full refund, subject to the applicable terms and conditions and the amounts recoverable from suppliers.

10. Responsibility for External Vendors

Jaguar Tours may coordinate or act as an intermediary for services provided by independent third parties, such as hotels, airlines, transportation providers, restaurants, tour guides, venues, insurance companies, local operators, or specialized suppliers.

Although Jaguar Tours strives to work with reliable suppliers, each supplier is directly responsible for the proper provision of the services for which it is responsible, in accordance with its own policies, permits, terms, and operating standards.

Jaguar Tours shall not be liable for any failures, delays, accidents, damages, losses, changes, cancellations, or deficiencies directly attributable to third-party providers, authorities, airlines, weather conditions, force majeure, or the customer’s own actions.

However, Jaguar Tours may assist the customer with the management, follow-up, or communication with the relevant suppliers, to the extent reasonably possible.

11. Travel Documents and Passenger Requirements

It is the customer’s responsibility to have valid and sufficient documentation to travel, including official identification, a passport, visas, immigration permits, certificates, authorizations for minors, health requirements, insurance, vaccinations, or any other documents required by authorities, airlines, hotels, venues, or service providers.

Jaguar Tours can provide general guidance on certain requirements, but such guidance does not replace the direct verification that the customer must carry out with official authorities, consulates, airlines, or the relevant institutions.

Jaguar Tours will not be liable if the customer is unable to travel, enter a destination, board a mode of transportation, stay at a lodging facility, or participate in an activity due to a lack of documentation, immigration requirements, medical conditions, legal restrictions, or failure to comply with applicable regulations.

12. Health, Mobility, and Safety Conditions

The customer must inform Jaguar Tours in advance of any health conditions, mobility issues, dietary requirements, age, disabilities, pregnancy, allergies, physical limitations, or special needs that may affect the planning or provision of the service.

Some itineraries, experiences, archaeological sites, cultural activities, religious tours, transfers, or visits may involve walking, climbing stairs, extended travel, changes in weather or altitude, or specific physical requirements.

Jaguar Tours may recommend adjustments, alternatives, or warnings when it has sufficient information, but the customer’s final decision to participate will be at their own risk, unless there is provable negligence directly attributable to Jaguar Tours.

13. Punctuality, Conduct, and Adherence to the Itinerary

The customer must arrive on time at the designated meeting times and locations.

Delays on the part of the customer may affect the itinerary, shorten visit times, result in additional costs, or lead to the loss of services without the right to a refund.

Jaguar Tours reserves the right to deny or suspend a person’s participation if their conduct poses a risk to themselves, other travelers, staff, vendors, facilities, local communities, or the smooth operation of the trip.

The customer must comply with laws, regulations, safety standards, tour guide instructions, venue policies, and religious, cultural, or community norms, as well as the terms and conditions of each service provider.

14. Travel for Groups, Agencies, and Tour Operators

When Jaguar Tours provides services to agencies, tour operators, institutions, religious groups, companies, schools, communities, or private groups, specific terms and conditions may be set forth in a proposal, contract, addendum, or separate business agreement.

For group trips, the organizer or group leader must inform participants of the trip conditions, itineraries, payments, cancellation policies, required documentation, schedules, and applicable rules.

Changes to the number of passengers, rooms, dates, itineraries, services, or group terms and conditions may affect the final price and availability.

15. Photographs, Content, and Promotional Materials

During certain trips or experiences, Jaguar Tours or its partners may take photographs or videos for documentary, promotional, or communication purposes.

In the case of images that identify customers, Jaguar Tours must obtain prior authorization when required by applicable law or when the use of such images goes beyond purely informational purposes related to the service.

The customer may request that their image not be used for promotional purposes by notifying Jaguar Tours in writing.

16. Intellectual Property

All content on the Jaguar Tours website, including text, photographs, logos, trade names, routes, designs, materials, proposals, itineraries, documents, and graphic elements, is the property of Jaguar Tours or is used with the permission of its respective owners.

The reproduction, distribution, modification, copying, publication, or commercial use of such content is prohibited without prior written authorization.

Quotes, itineraries, and proposals sent by Jaguar Tours are working documents intended for the customer and may not be copied, resold, reproduced, or used by third parties without authorization.

17. Information Published on the Site

Jaguar Tours strives to ensure that the information published on its website is clear, up-to-date, and useful. However, information regarding destinations, itineraries, schedules, attractions, services, estimated prices, or recommendations is subject to change without prior notice.

The images used on the website may be for illustrative purposes only and do not necessarily accurately represent the specific rooms, vehicles, meals, itineraries, experiences, or conditions of each service.

The final information will be that included in the corresponding quote, confirmation, or contract.

18. Promotions and Offers

Promotions, discounts, benefits, or special terms are subject to validity, availability, capacity, season, market conditions, payment method, and specific terms and conditions as indicated by Jaguar Tours.

Promotions cannot be combined with other offers, unless otherwise specified.

Jaguar Tours may modify, suspend, or cancel promotions in the event of errors, lack of availability, changes in suppliers, or other justified reasons.

19. Limitation of Liability

Jaguar Tours shall not be liable for damages, losses, expenses, delays, accidents, injuries, cancellations, itinerary changes, lost luggage, lost documents, acts of third parties, weather conditions, roadblocks, strikes, shutdowns, decisions by authorities, health emergencies, natural phenomena, transportation failures, or any event beyond its reasonable control.

Jaguar Tours’ liability, where applicable, shall be limited to the amount actually paid by the customer for the specific service in question and in accordance with applicable law.

Nothing in these Terms and Conditions is intended to limit the consumer’s inalienable rights where such rights apply under the law.

20. Refunds

When a refund is due, it will be processed in accordance with the applicable cancellation policy, the amounts recovered from suppliers, the payment method used, and the corresponding administrative or banking processing times.

Refunds may be subject to deductions for bank fees, administrative charges, supplier penalties, taxes, exchange rate differences, or services already provided.

Jaguar Tours will inform the customer of the amount and estimated timeframe for the refund once the specific case has been reviewed.

21. Travel Insurance

Jaguar Tours strongly recommends purchasing travel insurance that covers medical assistance, cancellations, trip interruptions, lost luggage, accidents, emergencies, and other unforeseen events.

Unless otherwise specified in the quote, travel insurance is not included.

The terms of the policy, coverage, exclusions, claims, and payments arising from an insurance policy will be subject to the terms and conditions of the respective insurer.

22. Protection of Personal Data

The processing of personal data will be governed by Jaguar Tours’ Privacy Notice, available on the website.

By providing their personal information, customers agree that Jaguar Tours may use it for purposes related to quotes, reservations, operations, follow-up, billing, customer service, marketing communications, and the provision of tourism services.

When necessary to operate the trip, Jaguar Tours may share certain information with relevant service providers, such as hotels, transportation providers, tour guides, tour operators, insurance companies, venues, or competent authorities, in accordance with the provisions of the Privacy Notice.

23. Billing

Customers who require an invoice must request it within the timeframe specified by Jaguar Tours and provide their tax information correctly.

Jaguar Tours will not be liable for errors resulting from incorrect, incomplete, or late tax information.

Invoices will be issued in accordance with current tax laws and based on the services actually paid for.

24. Official Notice

Official communications between Jaguar Tours and the customer may be conducted via email, WhatsApp, telephone, web forms, or other authorized channels.

The customer is responsible for providing accurate contact information and for staying informed about the information sent by Jaguar Tours before, during, and after the trip.

Jaguar Tours will not be liable for any issues arising from incorrect information, a lack of response from the customer, unread messages, or communications sent through unofficial channels.

25. Changes to These Terms and Conditions

Jaguar Tours may modify these Terms and Conditions at any time to reflect operational, commercial, legal, or service-related changes.

The current version will be the one published on the website. Any changes will not affect previously confirmed reservations, unless required by law, due to force majeure, or by agreement between the parties.

26. Applicable Law and Jurisdiction

These Terms and Conditions shall be governed by the applicable laws of the United Mexican States.

In the event of a dispute, the parties shall first attempt to resolve it through direct communication in good faith. If this is not possible, they shall submit the matter to the competent authorities in accordance with applicable law.
